PROVISIONS AS TO OFFENCES

Any person -

a. supplies unhallmarked article; or

b. supplies an article bearing any mark whether appearing to be an approved hallmark or to be a mark which is likely to be confused with the approved hallmark and which in accordance with the relevant section of the Law could if it was in the custody of the Assay Office to cancel or obliterate it; or

c. supplies from door to door articles except if that person has a certificate or registration according to the relevant section of the Law; or

d. who without authority strikes an article with a mark purporting to be a manufacturer's mark authorized under the Law or an Assay Office mark; or

e. with intent to defraud or deceive, makes a counterfeit of any die or mark; or

f. without lawful authority or excuse, has in his custody or under his control anything which is, and which he knows or believes to be, a counterfeit of a die or an article (whether or precious metal or not ) which bears a counterfeit of any mark; or

g. utters any counterfeit of a die or any article bearing a counterfeit of a mark; or

h. uses, registers or strikes a mark whether appearing to be an approved hallmark or to be a mark which is likely to be confused with the approved hallmark according to the provisions of this Law; or

i. removes any mark from an article of precious metal with the intent to transpose it to any other article (whether of precious metal or not) or affixes to any article (whether of precious metal or not) any mark which has been removed from an article of precious metal,

Shall be guilty of an offence and liable a fine not exceeding CYP.3000, or to a term of imprisonment not exceeding one year or to both such fine and imprisonment; and in case of a second or subsequent conviction to a fine not exceeding CYP.5000 or to a term of imprisonment not exceeding two years or to both such fine and imprisonment.
